I.    OUR ASSESSMENT OF YOUR ELIGIBILITY TO IMMIGRATE TO CANADA

We are in receipt of your completed Online Assessment Questionnaire and we thank you for the interest that you have shown in Immigration to Canada and in the law firm of Abrams & Krochak.

We are pleased to inform you that upon reviewing all of the necessary criteria in support of your Canadian Immigration claim, based on the information as provided to us by you, via e-mail, we have determined that we can assist you to apply for Permanent Residence in Canada in the Investor or Entrepreneur categories of the Business Class in accordance with the laws, regulations and policies in effect as of today's date.

Please note that our favourable assessment in the Investor category is conditional upon your satisfying the following three (3) criteria:

1.   You do, in fact, have a minimum net worth of at least 1,600,000 CAD, inclusive of the assets of your spouse/partner (if applicable);

2.   Your net worth was "legally obtained" (i.e. through business endeavours/inheritance/gift, etc.);

3.   Within any two of the last five years, you:

(i)   owned and managed a Qualifying Business that meets any two of the defined requirements for full-time (37.5 hours per week or more) employees, sales, net income and equity.

The following chart sets out the minimum requirements for a Qualifying Business at various percentages of ownership.

Please note that your qualifications have been personally assessed by a lawyer of this firm, Mr. Jeffrey Abrams, and, despite the speed of this evaluation, a thorough analysis of your eligibility to immigrate to Canada has been performed by our firm. II.    HOW TO RETAIN/ENGAGE OUR SERVICES

After reading the remainder of this assessment, should you wish to retain/engage our services, these are the steps that you must follow to retain/engage Abrams & Krochak's services and become a client of the firm.

Step 1: Remit your initial payment of Abrams & Krochak's legal fees (950 CAD). Payment instructions can be obtained by clicking here.

Step 2: Download a copy of Abrams & Krochak's Agreement and Schedule "A" to Agreement/100% Money-Back Guarantee by clicking here. Once you have downloaded the document, you must insert your name where you see the words "CLIENT'S NAME" exactly as your name appears in your passport. You must also sign the document where you see the words "CLIENT'S SIGNATURE". Your method of sending the signed Agreement and Schedule "A" to Agreement/100% Money-Back Guarantee to Abrams & Krochak will depend on your method of payment.

Step 3: If remitting the first installment of our legal fees, via wire transfer, credit card or VISA debit card, the signed Agreement and Schedule "A" to Agreement/100% Money-Back Guarantee can be faxed or scanned and e-mailed to our office.

If remitting the first installment of our legal fees, via money order/bank draft/cashier's cheque/traveller's cheque, the signed Agreement and Schedule "A" to Agreement/100% Money-Back Guarantee can be sent to our office, via mail or courier, in the same envelope as that in which you enclose your payment.

Just as soon as your initial payment has arrived in Canada, we shall prepare our preliminary package to send to you, via e-mail, which contains all of the necessary forms, document checklists, instructions and information so as to enable you to commence the Immigration process to Canada with our assistance.

III.    FEATURES OF IMMIGRANT INVESTOR PROGRAM

  1. Overview

    As an Investor, you must pay 800,000 CAD to the Government of Canada through a registered agent. Citizenship and Immigration Canada will prepare and deliver to you a debt obligation in the amount of 800,000 CAD, repayable (without interest) 30 days after the expiry of the five year allocation period. The investment is not refundable after visa issuance.

    Citizenship and Immigration Canada will allocate immigrant investment to approved provincial funds according to an allocation formula.

    Citizenship and Immigration Canada will subsequently distribute the money among the funds. After five years, the funds will repay Citizenship and Immigration Canada, for subsequent repayment to you. Essentially, you are making an interest-free loan to the Government of Canada.

  2. Timing of Investment

    While the investment is not made until the Application for Permanent Residence has been approved, at the time the Application for Permanent Residence is submitted, you will include the Investor's Acknowledgment identifying the government approved facilitator through which the investment will be made. Once you have retained our services, Abrams & Krochak will recommend a government approved facilitator for this purpose.

  3. Financing

    You may finance your investment in the Immigrant Investor Program through the services of the government approved facilitator with whom Abrams & Krochak will put you in touch once you have retained our services. In consideration of payment of 220,000 CAD plus or minus 8,000 CAD depending on the interest rates, an investor can secure the maximum loan from the government approved facilitator in order to complete the required 800,000 CAD investment. After the five (5) year obligatory investment period, that payment will have served to pay the interest on the loan and is not refundable.

VII.    PROCESSING TIMES

An Application for Permanent Residence CANNOT be processed from within Canada. Rather, it must be processed by a Canadian visa office (i.e. High Commission/Embassy/Consulate) situated OUTSIDE of Canada and an interview, if required, will take place at that visa office or at one of the satellite visa offices in the region where you reside. Therefore, there is no procedural advantage to your being in Canada while your Application for Permanent Residence is being processed by the visa office.

We can file your paperwork with a particular visa office if (i) you have at any point in the past lawfully resided for a period of one (1) year or more in any of the jurisdictions for which that visa office is responsible OR (ii) you are in possession of a valid visa, authorizing you to remain in any of the jurisdictions for which that visa office is responsible for a period of at least one (1) year. Otherwise, your documentation must be filed with the Canadian visa office responsible for your home country (i.e. country of habitual residence/citizenship).

Processing times can vary from as little as six to 12 months (if no interview is required) to two to three years, on average (if an interview is required). In general, processing times will depend on:

  1. the Canadian visa office through which you intend to apply for Permanent Residence in Canada;
  2. whether an Immigration interview is deemed necessary in your case;
  3. the complexity of your case;
  4. how well your case is presented; and
  5. the existing caseload in a Canadian visa office at a given time.

Please take note of the following information, regarding interview waivers.

When assessing an Application for Permanent Residence in Canada in the Business Class, Citizenship and Immigration Canada officials must satisfy themselves of several factors, including but not limited to:

  1. the applicants total personal net worth;
  2. the applicants business ownership and/or management experience;
  3. the applicants adaptability, resourcefulness and motivation to successfully establish himself/herself in Canada; and
  4. the applicants good character.

If, upon reviewing the applicant's Application package, Citizenship and Immigration Canada officials are satisfied that the documents filed address and satisfy each one of these factors, the recommendation can be made that the applicant's Application for Permanent Residence in Canada be approved without the need for a personal interview, thereby expediting the processing of the applicant's Application for Permanent Residence in Canada.

Please note that although we make every effort to have your Immigration interview waived, an Immigration interview may still be required because Citizenship and Immigration Canada officials randomly select very qualified applicants for Quality Assurance Interviews whereby the Department has an opportunity to satisfy itself that it is making the right decisions as to which cases merit waivers of interview.

Nobody can promise you a specific processing timeframe and any lawyer/consultant that guarantees processing times is being less than truthful with you. Lawyers/consultants can give estimates; however, they CANNOT guarantee processing times as processing times are ALWAYS subject to change WITHOUT advance notice.

VIII.    ABRAMS & KROCHAK'S FEES

  • 950 CAD is payable upon receipt of the client's draft Application forms for Abrams & Krochak's review and subsequent computer generation;

  • 950 CAD is payable upon receipt of the client's file number from Citizenship and Immigration Canada; and

  • 950 CAD is payable at the time that Citizenship and Immigration Canada notifies Abrams & Krochak and/or you that an interview appears not to be necessary in your case/an interview appears to be necessary in your case and/or at time of issuance of Immigration Medical Examination Forms (whichever event is earlier).

IX.    GOVERNMENT OF CANADA'S FEES

As for the Government of Canada's fees, they are your responsibility to pay and are not included in our legal fees.  The Government of Canada's fees consist of non-refundable processing fees and Right of Permanent Residence fees, which ARE refundable in the event that you submit the fees at the outset of the Application process and your Application for Permanent Residence in Canada does not succeed.  The fees are as follows:

(i)     Non-refundable processing fees (which must be submitted with your Application and which are payable at the time that second payment of Abrams & Krochak's legal fees is due)

  7. If the application is returned by Citizenship and Immigration Canada.

XI.      FOURTEEN EASY STEPS TO IMMIGRATE AT ABRAMS & KROCHAK

When an individual becomes a client of Abrams & Krochak, the very first thing he/she will receive from the firm is the firm's preliminary package, which contains all of the necessary forms, document checklists, instructions and information to enable the client to commence the Canadian Immigration Application process with Abrams & Krochak's assistance. Set out, below, are the subsequent steps that clients should follow to ensure a smooth and successful Application process.

Step 1: Introduction The client reads the preliminary package carefully and follows the instructions as contained therein.
Step 2: Application Forms The client fills out the Government of Canada Application forms on Abrams & Krochak's client website.
Step 3: Complete Application Forms The client sends his/her completed Application forms via Abrams & Krochak's client website to the firm for review. THE CLIENT IS NOT TO SEND ANY OTHER DOCUMENTS AT THIS TIME. Second Payment of Abrams & Krochak's legal fees is due.
Step 4: We Computer
Generate Application Forms
for You
Upon receiving the second payment of Abrams & Krochak's legal fees, the firm reviews the clients Application forms. If the forms are complete, the firm will computer generate the Application forms and e-mail them back to the client for approval and signature. If further information/clarifications are required from the client, the client will be notified, via e-mail.
Step 5: Send Documents
to our Office
The client sends all of his/her documents (if required) and signed computer generated Application forms to the firm by courier. The client must also send the Government of Canada's fees to Abrams & Krochak at this time.
Step 6: Legal Arguments Prepared If the client's documents are acceptable, the firm will prepare detailed written, legal arguments to accompany the client's Application package and e-mail the written, legal arguments to the client for the client's approval prior to inclusion with the Application package.
Step 7: Send Your Application Package to Visa Office When the client approves the written, legal arguments, the client's entire Application Package inclusive of the written, legal arguments will be sent to the Canadian visa office for processing.
Step 8: Acknowledgment Received The visa office will acknowledge receipt of the Application and may request more documents. Third payment of Abrams & Krochak's legal fees is due.
Step 9: Interview Date/Waiver Notification The visa office will inform Abrams & Krochak of the client's interview date or waiver of interview. Additional documents may also be requested at this time. If the interview is waived, the client must undergo the Immigration Medical Examination, immediately. If an interview is required, the client should undergo the Immigration Medical Examination approximately one (1) month prior to the interview. Final payment of Abrams & Krochak's legal fees is due.
Step 10: Interview Preparation If an interview is required, Abrams & Krochak's interview preparation package is sent to the client, via e-mail, which includes sample interview questions.
Step 11: Interview Answer Analysis If an interview is required, the client submits answers to Abrams & Krochak's sample interview questions to the firm for review and analysis.
Step 12: Interview If an interview is required, the client attends the interview at the Canadian visa office.
Step 13: Decision A decision is made by the Canadian visa office. If the decision is positive, the Government of Canada's Right of Permanent Residence fees must be paid (if not paid earlier) and the client will be asked to forward his/her passport to the Canadian visa office for immigrant visa insertion.
Step 14: Completion If the decision is positive, the passport is returned to the client with immigrant visa affixed therein. The immigrant visa will bear an expiration date and the client must arrive in Canada prior to the expiration date to become landed. Congratulations! If arriving in Toronto, the client is invited to visit Abrams & Krochak's office to receive free settlement advice.
