Number of 2017 New Arrivals to Canada to Remain the Same; Greater Percentage Economic and Family Class Immigrants

On October 31, 2016, the Government of Canada announced in the Canadian House of Commons that it will bring in 300,000 new arrivals in 2017. That is the same number that was established in 2016 to accommodate an influx of Syrian refugees.

While Canada will not increase the number of new immigrants being welcomed to the country next year, the Government claims that it is laying the foundation for a bigger boost in levels in the coming years.

Within this plan, the number of permanent residents selected in economic programs (i.e. Express Entry/Business Class/Provincial Nominee Programs, etc.) will increase. The Government also intends to increase Family Class (i.e. family sponsorship) levels to reduce processing times and reunite more families.

Canadian Broadcasting Corporation reports that Immigration Minister John McCallum to reveal ‘substantially’ higher newcomer targets

Canada is expected to “substantially” boost the number of immigrants it welcomes to the country each year, but experts warn that any increase must be matched with more robust resettlement assistance.

Immigration, Refugees and Citizenship Minister John McCallum is expected to reveal new targets Monday, one day before Finance Minister Bill Morneau presents his fall economic update.

The new levels will seek to offset projected demographic challenges in Canada, including an aging population and growing labour gaps. In 2016, the target was to permit 300,000 newcomers to the country.

The government’s economic growth advisory council has recommended ramping up immigration levels to 450,000 people a year over the next five years, with a focus on skilled, highly educated and business-oriented people. McCallum has suggested that target may be overly ambitious, but said the government will “substantially” raise the number.

There has also been debate among the Canadian public — and among Liberals — about hiking immigration at a time of high unemployment, especially among young Canadians. There are also questions about whether adequate levels of support are in place.

Immigrants worse off?

As the government welcomes more immigrants, it must take steps to ensure smooth integration into communities, said Emily Gilbert, director of the University of Toronto’s Canadian Studies Program. That includes employment that meets their skill levels, so families don’t face undue financial hardship, she said.

“I’m not at all against raising the level, I’m in full support of that. But we’ve had a tendency in the last decade or so for newcomers to Canada to be much worse off economically,” she said.

She’s concerned about the potential emphasis on bringing in business and professional class immigrants.

“I’m worried that the thrust of the levels seems to be to boost Canada’s economy and I’m worried it would be on the shoulders of those who arrive,” she said.

Gilbert said ramping up numbers too quickly without enough supports could lead to potential social and economic problems down the road. She also warned against gearing targets based on economic status.

Not only does that contribute to a “brain drain” in other countries, but it ignores the fact that it takes all kinds of people to build the country, she said.

Raise living standards

The advisory council’s report recommends tapping top business talent and international students to maximize economic benefits from immigration policy that, “if done right, can raise living standards for all Canadians.”

Noting that public opinion to date is largely favourable toward immigration, the report warns that policy makers must be aware of limits.

“Public support is likely to wane if integration of new immigrants is not managed effectively,” it reads. “The recommended increase of 150,000 permanent economic immigrants is not expected to strain public education, transportation, or healthcare systems over the course of the five-year ramp up period, though it should be expected that higher population growth will eventually require increased investments in public services and infrastructure by all levels of government.”

In addition to boosting immigration levels, the council recommends:

  • Reducing red tape to attract and expedite entry for foreign talent.
  • Easing rules to allow more international students to become permanent residents.
  • Improving accreditation processes to help skilled workers find work in their profession.

Dory Jade, CEO of the Canadian Association of Professional Immigration Consultants, expects the government will significantly increase the annual target and numbers in various categories. He said it’s difficult to measure actual capacity for newcomers in communities because there are so many regional variations.

Big dilemma

But Jade said any increase in numbers must come with supports ranging from more staff to process applications to a “big injection” of aid to help integrate new arrivals, even though that capacity is hard to determine.

“That’s the big dilemma for the government,” he said.

NDP Immigration critic Jenny Kwan said Canada could reasonably have a policy to bring in a higher number of immigrants, up to 500,000 annually.

Along with setting new targets, she urged the government to bring in policy changes that would help fill regional labour gaps and give live-in caregivers and temporary foreign workers greater and faster opportunities to become new Canadians.

“I think we’re at the juncture in 2016 to look at our immigration policy and say, ‘If you’re good enough to work here, you’re good enough to stay,'” she said.

Kwan also said Canada’s policy should not be geared to favour those with business and professional credentials.

“There’s value to all the different classes,” she said. “All of us contribute to the rich fabric of who we are, and our immigration policy should reflect exactly that — broad-based, diverse groups of immigrants from around the globe.”

Conservative Immigration critic Michelle Rempel said setting immigration levels must not be “arbitrary” and that targets should be established after consultation with the provinces and territories. She hopes to to see an increase in economic immigration to the Atlantic provinces and consideration to Francophonie targets.

Rempel said she is proud that because of a Conservative motion, Yazidi victims of ISIS genocide will be among the priority groups brought in to Canada.

“Our previous Conservative government oversaw the highest sustained levels of economic immigration in Canada’s history, while working to ensure persecuted ethnic, religious and sexual minorities were able to resettle in Canada,” she said in an email.

“We protected the integrity of our fair and generous immigration system by cracking down on crooked consultants who exploit prospective immigrants. Along with introducing the Parent and Grandparent Super Visa, we also enhanced the Caregiver program to ensure faster processing, reunification and more protection against abuse.”

DEADLINE FOR FILING FEDERAL SKILLED WORKER APPLICATIONS

Citizenship and Immigration Canada has just amended its website and has confirmed that, in order for a Federal Skilled Worker Application to be assessed under CURRENT eligibility and selection criteria (i.e. May 1, 2014 General Occupations (Demand) List and 67 point pass mark), the Application MUST be received by Citizenship and Immigration Canada BEFORE January 1, 2015.

What does this mean?
(a) Existing Clients of Abrams & Krochak
If you are a Federal Skilled Worker Program client of Abrams & Krochak who has not yet filed his/her Application for Permanent Residence in Canada but wishes to be assessed by Citizenship and Immigration Canada under the CURRENT Federal Skilled Worker eligibility/selection criteria (i.e. May 1, 2014 General Occupations (Demand) List and 67 point pass mark), your COMPLETE Application package (including forms/supporting documents/IELTS scores/Educational Credentials Assessment/Government fees) MUST be received by Abrams & Krochak NO LATER THAN December 15, 2014.  Otherwise, you run the risk that your Application will not be filed before January 1, 2015 and you will be subject to the new Express Entry processing system.
If your COMPLETE Application package arrives at Abrams & Krochak’s office AFTER December 15, 2014, we cannot guarantee that your Application will be filed with Citizenship and Immigration Canada prior to January 1, 2015.  However, should clients wish to pay a 400 CAD priority processing fee to Abrams & Krochak, our staff will work over the Christmas holidays to ensure that your Application is filed prior to January 1, 2015.

(b) Potential Clients of Abrams & Krochak

If you have had your eligibility to immigrate to Canada in the Federal Skilled Worker Class favourably assessed by Abrams & Krochak PRIOR TO November 28, 2014 and wish to become a client of the firm, but have not yet retained/engaged Abrams & Krochak’s services, Abrams & Krochak will NOT be able to file your Application under the current Federal Skilled Worker Program (i.e. May 1, 2014 General Occupations (Demand) List and 67 point pass mark), should you subsequently become a client of the firm.  Your Application will be subject to the new Express Entry system to take effect on January 1, 2015 and you should send an e-mail to askus@akcanada.com, with the request for a reassessment of your Immigration eligibility under the Express Entry system.
WHAT IS EXPRESS ENTRY?

The Express Entry system will take effect on January 1, 2015 and involves two (2) steps:Step 1

Potential candidates will complete an online Express Entry profile where they will provide information about their skills, work experience, language ability, education, and other details. Those who meet the criteria of one of the federal economic Immigration programs (i.e. Federal Skilled Worker) subject to Express Entry will be placed in a pool of candidates.
Candidates will be ranked against others in the pool. Only the highest-ranked candidates (those deemed to have the best chances for economic success), and those with qualifying offers of arranged employment or provincial/territorial nominations, will be invited to apply for Permanent Residence.
If a candidate does not already have a valid job offer from a Canadian employer or a provincial/territorial nomination, he or she must register with the Government of Canada’s Job Bank which will connect him or her with eligible Canadian employers.
Where applicable, employers will be required to obtain a Labour Market Impact Assessment from Employment and Social Development Canada. There will be no government fee for Labour Market Impact Assessments for Permanent Residence Applications under the Express Entry system.
Completing an online Express Entry profile does not guarantee that a candidate will receive an Invitation to Apply for Permanent Residence.

Step 2

Candidates will receive an Invitation to Apply for Permanent Residence if they rank among the top in the pool, based on their skills and experience. Candidates who have a valid job offer from a Canadian employer (subject to the Labour Market Impact Assessment process in place at that time) or have been nominated by a province or territory will be given high scores in the ranking system.
Candidates will have sixty (60) days to submit an electronic Application for Permanent Residence through one of the following programs:
Federal Skilled Worker Program (FSWP);
Federal Skilled Trades Program (FSTP);
Canadian Experience Class (CEC); or,
A portion of the Provincial Nominee Program (PNP)
Citizenship and Immigration Canada will process the majority of complete Applications (i.e. Applications including all the necessary supporting documents) within six (6) months or less.
Candidates in the Express Entry pool who do not receive an Invitation to Apply for Permanent Residence after twelve (12) months may resubmit their profile and re-enter the pool if they still meet the criteria. This provision will prevent backlogs and ensure quick processing times.

This blog is directed to the many individuals who contacted the law offices of Abrams & Krochak in 2010 or 2011 to explore the possibility of immigrating to Canada as a skilled worker with Abrams & Krochak’s assistance. If you have not already applied and are still considering migrating to Canada as a skilled worker and had your eligibility to do so favourably assessed by Abrams & Krochak, we STRONGLY suggest that you proceed NOW with your proposed Canadian Immigration plans. Much is happening in Canada, right now, which could negatively affect your eligibility to immigrate:

1. Federal Skilled Worker Quotas

For the period of July 1, 2010 to June 30, 2011, Citizenship and Immigration Canada (CIC) imposed a quota of 20,000 new Federal Skilled Worker Applications with a maximum of 1,000 applicants in each of the 29 jobs that appeared on the General Occupations (Demand) List. For the period of July 1, 2011 to June 30, 2012, CIC kept the same General Occupations (Demand) List of 29 jobs; however, it slashed the quotas in half. CIC imposed a new quota of only 10,000 new Federal Skilled Worker Applications with a maximum of 500 applicants in each of the 29 jobs that appeared on the General Occupations (Demand) List.

Who knows what quotas CIC will impose when it publishes the new General Occupations (Demand) List on July 1, 2012?

As of January 9, 2012, quotas for the July 1, 2011 to June 30, 2012 time period were already filling fast. A total of 6,205 Federal Skilled Worker Applications out of a possible 10,000 had already been received by CIC and the quotas for the following jobs had already been filled:

0631 – Restaurant and Food Service Managers

1122 – Professional Occupations in Business Services to Management

2121 – Biologists and Related Scientists

3131 – Pharmacists

3152 – Registered Nurses

Furthermore, the quotas for the following jobs were very close to being filled:

3111 – Specialist Physicians

3112 – General Practitioners and Family Physicians

3113 – Dentists

2. Federal Skilled Worker Points System

CIC is proposing changes to the Federal Skilled Worker program to help Canada select immigrants who have the best chance of integrating and making a better contribution to the Canadian economy.

CIC is consulting with stakeholders and the public on the proposed changes. The input received through the consultation process will be taken into account in the development of new regulations, which could take effect as early as the late spring/summer of 2012!

What are some of the proposed changes?

introducing minimum official language thresholds and increasing points for language;

making changes to the assessment of education points to reflect a foreign educational credential’s value in Canada;

redistributing points for age to benefit younger immigrants who will be active members of the workforce for a longer timeframe;

reducing points for foreign work experience and increasing points for Canadian work experience;

increasing the integrity of and simplifying the process for the Arranged Employment factor; and

facilitating the immigration of skilled tradespersons through criteria that are more specific to those in the skilled trades.

3. Federal Skilled Worker General Occupations (Demand) List

In late June/early July 2012, CIC will be releasing a new General Occupations (Demand) List for the July 1, 2012 to June 30, 2013 period. There is a misconception on the part of many people that the List will be a repeat of this year’s List. To set the record straight, there is ABSOLUTELY NO GUARANTEE that the new List will remain the same as the old List and that the jobs that appear on the old List will also appear on the new List. If your job is currently in demand and on the List but disappears from the new List, you will lose the opportunity to migrate as a skilled worker unless you have Arranged Employment (which is difficult to obtain).

4. What Does This All Mean?

With so much uncertainty in the air as to what will happen with the Federal Skilled Worker Class (i.e. its quotas, the way points are assessed and which jobs will be in demand), one thing IS certain: NOW is the time to apply if you know you qualify and the quota for your occupation has not yet been filled.

New Canadian act targets ‘Ghost’ immigration agents

(IANS) ‘Ghost’ immigration consultants in India, who dupe people desperate to migrate to Canada, will be put out of business with the passing of new legislation by the Canadian parliament.

Canadian Immigration Minister Jason Kenney said the legislation to crack down on crooked immigration consultants has received final approval Tuesday in the House of Commons.

The new Act will crack down on crooked immigration consultants who undermine the integrity of Canada’s immigration system, the minister said.

‘In their quest for personal gain, crooked consultants have displayed a wanton disregard for our immigration rules and bilked too many people out of their hard-earned dollars,’ said Kenney.

‘They are a menace, posing a costly threat not only to their victims, but also to the integrity and fairness of our immigration system. When crooked consultants encourage prospective immigrants to cheat the system, it slows down the immigration system for those following the rules,’ the minister said.

The new Act makes immigration services provided by any unauthorised immigration agent illegal.

‘This includes services offered or performed before an application is submitted or a proceeding begins, thus closing a loophole in the current framework. It would also give the minister the authority to designate a body to govern immigration consultants and authorize the Governor in Council to make regulations to enhance the government’s oversight of this body.’

According to Canadian authorities, India-based ‘ghost’ immigration consultants — who operate in collusion with their Canada-based fraud partners — pose a major challenge to this country’s immigration system.

Operating out of the purview of law, these ‘ghost’ immigration consultant cheat thousands of prospective immigrants each year, defrauding them up to $30,000 each.

Such operators are rampant, especially in Punjab, as migrant families from that state in Canada want to bring their relatives here by hook or by crook.
